Out of service for more than 50 years.
Comments / Recommendations
− +BACKGROUND:
The applicant is requesting to close a recorded, but not built, public street that runs between Baldwin Avenue and McCarty Avenue. If developed, the street could provide access to 2 parcels - 109IG002 and 109IH017. If closed, those two parcels would be landlocked without a means of access except by access easement through a neighboring property. The applicant has submitted a separate plat application that will resolve the landlocked issue once approved (case # 10-SA-24-F).
COMMENTS:
The reviewing departments and organizations had these comments:
- Planning: Since the applicant has provided a plat that resolves what would otherwise be a landlocked situation, we have no objections with the closure.
- City of Knoxville Engineering: City Engineering has no objections to the closure. Should this right-of-way be closed, the City will reserve easements for all drainage facilities and utilities, if there are any current facilities, located in or within five (5) feet of the property described herein. No easements are reserved if there are no current facilities within the closure area. If any existing facilities or utilities are found not feasible to the site development or use, they may be removed and relocated, subject to City Engineering and/or other applicable easement holder review and approval.
Further, closure of this street would not legally landlock any properties including Tax I.D. 109IH017 and 109IG002, as they are owned by Bobby Smelcer who would also be acquiring title to a portion of the abutting closure area of Dooley St. Mr. Smelcer also owns properties to the north and west that can facilitate access to these parcels from W Blount Ave. Mr. Smelcer intends to consolidate these properties once the closure acquisitions have been finalized and there is no known need to impose any access conditions to validate this closure request.
- Addressing: The proposed ROW closure is not expected to impact any existing addresses.
- Fire Department: Approved for fire department access.
- KUB: We have reviewed our records and, as far as we have been able to determine, KUB has no existing utility facilities located within the subject right-of-way areas and we have no objection to the requested closures. However, KUB does not release and hereby retains all easements and rights for existing facilities, whether or not identified in our research.
- AT&T: AT&T does not dispute this request to close the descried right of way.
- TDOT: The roadway closure requested for review has no impact to State owned ROW. Therefore, TDOT takes no exception to the request.
