Staff Recommendation
Approve the development plan to reduce the previously approved front setback from 30 ft to 25 ft in the PR (Planned Residential) up 3 du/ac zone as depicted on the site plan, subject to 3 conditions.
1) Meeting all other applicable requirements of the Knox County Zoning Ordinance.
2) Meeting all requirements of the Knox County Department of Engineering and Public Works.
3) If during plat approval or construction of the development, it is discovered that unforeseen off-site improvements within the right-of-way are necessary as caused by this development, the developer will either enter into a Memorandum of Understanding with the County for these improvements or reimburse the County for their direct expenses (if competed by County crews) to make corrections deemed necessary.
In 2023, a concept and development plan for 4 single family lots was approved (11-SB-23-C/11-C-23-DP). The PR zone requires setbacks to be determined by the Planning Commission and subsequently listed on the plat. This plan requests reducing the front setback from 30 ft to 25 ft on one lot, Lot 415 of Arcadia - Phase 4A.
DEVELOPMENT PLAN ANALYSIS PER ARTICLE 6, SECTION 6.50.06 (APPROVAL OR DENIAL)
In the exercise of its administrative judgment, the Planning Commission shall determine if the proposed plan is in harmony with the general purpose and intent of the zoning ordinance and adopted plans.
1) ZONING ORDINANCE PR (Planned Residential) up to 3 du/ac:
A. The Planning Commission determines setbacks in the PR zone, which allows a minimum front setback of 15 ft. This development plan requests reducing the front yard setbacks from 30 ft to 25 ft.
B. The proposed development does not change the density of the subdivision. The single family use and the existing 0.24 du/ac density are in conformance with the zoning and have been previously approved.
2) KNOX COUNTY COMPREHENSIVE PLAN - IMPLEMENTATION POLICIES
A. Ensure that development is sensitive to existing community character. - In the Arcadia subdivision, the most common front setback has been 30 ft along Arcadia Peninsula Way. The 25-ft setback is very similar to the 30-ft setback.
3) KNOX COUNTY COMPREHENSIVE PLAN - PLACE TYPE
A. The property is classified as SR (Suburban Residential) place type which specifies setbacks of 20-30 ft. The site plan provided meets the dimensional requirements of the PR zone and form attributes of the SR place type.
4) KNOXVILLE - FARRAGUT - KNOX COUNTY GROWTH POLICY PLAN
A. The property is within the Planned Growth Boundary. The purposes of the Planned Growth Boundary designation are to encourage a reasonably compact pattern of development, promote the expansion of the Knox County economy, offer a wide range of housing choices, and coordinate the actions of the public and private sectors, particularly with regard to the provision of adequate roads, utilities, schools, drainage and other public facilities and services. This development is in alignment with these goals.
