Reason for Closure
This closure will be within the current TDOT Right of Way however it is shown as existing. City Engineering and TDOT require closure to access 095OE03101. See attached documentation that reflects current conditions as well as previous Right of Way information. Only one property owner (the applicant) is impacted by the closure.
Comments / Recommendations
− +-Planning: Planning has no objections to the proposed closure. It does not impact connectivity to any other parcels. The section of Ford Pl that is proposed to be closed does have a road bed. However, it is not maintained, and has become impassable with overgrown vegetation. If the ROW is closed, a new plat defining legal access for parcel 095OE03101 would be needed.
-Engineering: City Engineering has no objections to the closure. Should this right-of-way be closed, the City will reserve easements for all drainage facilities and utilities, if there are any current facilities, located in or within five (5) feet of the property described herein. No easements are reserved if there are no current facilities within the closure area. If any existing facilities or utilities are found not feasible to the site development or use, they may be removed and relocated, subject to City Engineering and/or other applicable easement holder review and approval.
-KUB: We have reviewed our records and find that we have existing utility facilities located within the subject right-of-way. The approximate locations of these facilities are indicated on the enclosed prints. However, KUB does not release and hereby retains all easements and rights for existing utility facilities, whether or not shown on these prints. Should this right-of-way be closed, KUB will require the following permanent easements for its utility facilities.
Electric/Fiber - 10 feet on each side of the centerline of the overhead lines, 20 feet total width
-Addressing: The proposed ROW closure is not expected to impact any existing addresses.
-Fire Department: Approved.
-TDOT: TDOT has reviewed and agrees to the closure. The closure of ROW has no impact to State Owned property. TDOT Excess land has been working with the local municipalities as well as the property owner regarding this request. TDOT Excess land will require the property owner to purchase and relocate control access as part of their acquisition. The Control Access fence is in the appropriate location and will remain as presently located. TDOT Right of Way has performed a check to ensure the property can have restored access through the Excess Land process.
